Background

Kovacs-Colón initiated his career as an attorney in a major life insurance company, being responsible for tax, securities and insurance law compliance applicable to an array of tax advantaged products and markets. His experience included managing relationships with major public sector employers across the country as well as the various tax advantaged products subject to both state and federal regulation. This provided additional benefits to clients in his subsequent years in private practice, where he was a partner in large firms, heading up the ERISA practice group in the second one. Kovacs-Colón applies his legal experience in not only the soundness of the business structure ,but also the workings of any funding source paired to produce the client's tax and financial objective. He restructured a law firm's profits sharing 401(k) plan and converted their non-qualified plan into a Cash Balance plan, enabling the firm to more securely provide for its succession strategy. He designed, drafted and an obtained a favorable determination letter for the ESOP of a national auto parts manufacturer, assisting in its bank financing and related corporate issues, and guided its implementation of the Section 1042 transaction for the founder of the company. Through his career, Kovacs-Colón has presented in many local and regional seminars, professional and industry, on topics ranging from Executive Compensation, Breach of Fiduciary Responsibility to Tax Issues in Separation Agreements and Uses of Employer Stock in Qualified Plans.
